As a civil rights attorney, partner Michael Winkelman is acutely aware of the need for police reform. In light of the recent murder of George Floyd, Breonna Taylor, and countless other Black Americans by police, and the numerous protests taking place across the country, Maryland State Senator William C. Smith, Jr., who is a Chairman on the Senate Judicial Proceedings Committee, has requested that proposed legislation be drafted to address various aspects of police reform for the next legislative session. Senator Smith reached out to the Maryland Association for Justice for input on the issue as it relates to civil tort law.

The Maryland Association for Justice (MAJ) advocates for the preservation of the civil justice system, the protection of the rights of consumers, and the education and professional development of its members. Michael Winkelman is on the Board of Governors for the MAJ and together with a handful of other civil rights attorneys, they were part of a legislative subcommittee to set forth a report for Senator Smith.

This report includes a review of the problems with current law, including the State and Local Government Tort Claims Acts, and proposes changes that should be made. This report seeks to educate legislators and the public on deficiencies in our current police brutality tort laws.
